$10 Second Chance Rules

RULES AND REGULATIONS

1. One entry consists of one $10 eligible non-winning Nebraska Lottery Scratch ticket entered by mail or one $10 eligible non-winning Nebraska Lottery Scratch ticket entered by website submission. Each entry is valid for one quarterly drawing.

2. Eligible non-winning $10 Scratch tickets:

Game #365 --- $250,000 Payday
Game #398 --- 10 Times Lucky
Game #399 --- Lucky 7’s Casino
Game #436 --- Dazzling Diamonds

3. No other tickets or entries are eligible for this promotion, including non-winning Scratch or Lotto games not listed as eligible for entry in rule #2, Scratch games listed in #2 that won a prize, Scratch sample-void tickets, altered or stolen tickets, standard postcards, photocopies, reproductions, facsimiles, any voided ticket, or any likeness of an authentic ticket.

4. Entries may be entered by mail or through the Nebraska Lottery’s website at www.nelottery.com. Players entering through www.nelottery.com must keep their entry since they will be required to turn the physical ticket in to the Nebraska Lottery to claim any prize won (See rule #16). Players may not enter other Nebraska Lottery promotions with the same entries submitted in this promotion either through the mail or the web. Players may not simultaneously enter the same ticket twice via both the mail and the web.

5. Except for Game No. 436, entries mailed to the Nebraska Lottery do not need an envelope. Players must completely fill out their name and address on the ticket back and should include a daytime phone number for contact purposes. Place a first class stamp on the ticket and deposit in the mail. “Hand delivered” entries will not be accepted at any Nebraska Lottery claim center nor at the Nebraska Lottery headquarters in Lincoln, Nebraska. Mailed entries must be sent from Nebraska addresses only.

6. Entries will be accepted until May 9, 2008 or until the last eligible game closing date, whichever occurs first. The mailing address is: “$10 Scratch Games Giveaway”, Nebraska Lottery, P.O. Box 98930, Lincoln, NE 68509-8930.

7. Entries must be received at the address listed in Paragraph 6 by 5:00 p.m. (C.T.) on the deadline dates. Entries entered through the Nebraska Lottery’s website at www.nelottery.com must be entered by 5:00 p.m. (C.T.) on the entry deadline dates. The Nebraska Lottery is not responsible for entries received after the deadlines. Duplicate web entries will be considered null and void. Simultaneous entry of one $10 eligible non-winning ticket by both mail and website will disqualify the mail-in entry.

8. Only entries received by the appropriate entry deadline date (as listed below) will be eligible for that quarter’s corresponding drawing. Entries received at the address listed on the back of the ticket or entered at www.nelottery.com after the quarterly entry deadline date will be eligible for the next scheduled quarterly drawing. Entries for the last quarterly drawing will be accepted until 5:00 p.m. (C.T.) on May 9, 2008 or on the last eligible game closing date, whichever occurs first. In the event the last eligible game closes prior to May 9, 2008, the last quarterly drawing will be on the next scheduled drawing date immediately following the game closing date. Entries received after the deadline for the final quarterly drawing will be deemed ineligible and will be destroyed.

9. All eligible entries received by the listed entry deadline dates will be placed into a drawing for a chance to win the following prizes:

QUARTERLY DRAWING:
First Prize: $2,500
Second Prize: One (1) pack of thirty (30) $10 scratch tickets OR other scratch tickets of equal or greater value as selected and determined by the Nebraska Lottery.

10. Players may mail each entry in a separate envelope instead of using the ticket back, if applicable to the eligible ticket. Multiple entries mailed in one larger envelope are acceptable. If multiple entries are mailed together in one larger envelope, the larger envelope must be clearly marked “Multiple Entries Enclosed.” Envelopes containing multiple entries but not marked “Multiple Entries Enclosed” will be considered as one entry.

11. The entrant’s complete name, mailing address, and telephone number should be completed on the back of the ticket used for entry, or on the entry completed on www.nelottery.com so that the owners of winning entries can be identified and contacted. Incomplete or illegible entries may be disqualified. Entries with address stamps or stickers are acceptable, but these should also have a complete name and mailing address. A telephone number is recommended for contact purposes.

12. The Nebraska Lottery is not responsible for lost, late, returned, delayed, misdirected, damaged, incomplete, altered, illegible, or postage-due mail. The Nebraska Lottery is not responsible for any non-promotional mail inadvertently sent to the promotional address.

13. Players may enter each quarterly drawing as often as they wish, but a player can win only one prize in each quarterly drawing. Although players can win only one prize in a given quarterly drawing, they can win more than once during the course of the promotion. Individual players living in the same household may each win a prize in the same promotional drawing. There is no limit to the number of entries received per person per drawing.

14. Only one person’s name must appear on any of the tickets drawn as a winner. If multiple winners’ names are placed on one ticket, these individuals will be notified and it will be their responsibility to declare which individual will claim ownership of the prize. The Nebraska Lottery will award a prize to only one winner.

15. Winners will be notified by mail and/or phone. Winners may be asked to provide valid identification and complete a claim form. A winner must comply with all instructions in the written prize notification and the winner's complete response (submission of the physical ticket and claim form) must be received by the Nebraska Lottery within thirty (30) days of the date on the written prize notification or the prize will be forfeited and an alternate winner selected. The Nebraska Lottery will make every attempt to contact the winner using the information submitted either on the ticket back or through the web. The Nebraska Lottery is not responsible for lost, returned, or delayed mail pertaining to the written prize notification, the winner’s complete response, or due to the wrong address or phone number submitted by the winner.

16. Prize winners who enter through www.nelottery.com will be required to furnish the Nebraska Lottery with the actual $10 Scratch ticket with the corresponding validation and ticket numbers used to enter the promotion within thirty (30) days from the date issued on the written prize notification announcing their entry being drawn as a winner. Prize winners may not substitute the actual ticket with a fax, photocopy, or other reproduction of the ticket. If the winner is unable to furnish the actual ticket within the stated time limit, no prize will be awarded and the next alternate will be contacted.

17. Entries remaining after the quarterly drawing will be null and void and ineligible for entry into any other promotion conducted by the Nebraska Lottery and will be destroyed. Entries will not be returned to the players once they are received by mail.

18. Only persons 19 years of age or older are eligible to enter and win. Winners may be required to furnish proof of age. Entrants must be eligible to purchase and redeem the Nebraska Lottery and otherwise must comply with the State Lottery Act, and the rules, regulations, policies and procedures of the Nebraska Lottery.

19. The odds of winning depend on the number of eligible entries received for each drawing.

20. By participating in this promotion, prize winners agree to be photographed and videotaped by the Nebraska Lottery and have their images and non-confidential information about them used in advertising, publicity, and in educational and promotional activities of the Nebraska Lottery. The Nebraska Lottery is not required to provide any additional consideration or remuneration for these activities.

21. Each person entering this promotion agrees by their act of participation to be bound by these rules and procedures and the statutes and administrative rules and procedures of the Nebraska Lottery.

22. No substitution or transfer of prizes will be allowed. Upon delivery of any prize to the winner, the Nebraska Lottery will be deemed to have awarded the prize to the winner with the winner assuming full ownership and responsibility for the prize. All prize awards are final.

23. The Nebraska Lottery makes no express or implied warranties of any kind with respect to the safety, appearance, or performance of any prize offered.

24. The Nebraska Lottery and its agents are not responsible for error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to, or alterations of, entry materials or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or for inaccurate transmission of or failure to receive entry, winner, or other contest information by sponsors or entrants for any reason whatsoever. The Nebraska Lottery is not responsible for any injury or damage to any entrant's or any other person's computer related to or resulting from playing or downloading any materials in this promotion contest or for entries that are late, misdirected or incomplete. All entries become the sole property of Nebraska Lottery and will not be returned. No telephone calls to confirm receipt of an entry will be accepted.

25. In the event of early termination of this promotion, a random drawing will be held among all eligible entries received at the time of termination. The Nebraska Lottery reserves the right to disqualify any entrant found tampering with the entry process, or with the operation of the drawing, or with the website. [CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATIONS OF THE PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE NEBRASKA LOTTERY RESERVES THE RIGHT TO CANCEL THE PROMOTION IF IT BECOMES TECHNICALLY CORRUPTED.]

26. The Nebraska Lottery reserves the right to use information from entries following the drawing date to obtain player information for statistical and other purposes. Although entries selected in the drawing will be reviewed to determine their compliance with the rules, other entries will not be examined to determine whether they contain winning tickets, include other Lottery correspondence, or constitute misdirected mail.

27. In the event of a dispute arising out of these rules and procedures a player’s sole remedy is limited to entry into another promotional drawing or event with prizes of a similar value. Any decision made by the Nebraska Lottery to resolve disputes is final.

28. Employees of the Nebraska Lottery and its contractors, subcontractors, and their immediate family members residing in their same household are ineligible to participate in this promotion.

29. Promotion rules and procedures and drawing dates and deadlines are subject to change as may be determined necessary or appropriate by the Lottery Director in his or her sole discretion without additional public notice.

30. Neither the Nebraska Lottery nor its vendors or suppliers are liable for any damages or delays which result from acts of God, public enemy, earthquake, fire, flood, explosion, epidemic, quarantine, strikes, freight embargoes, closure of all major access roads to a geographic region, weather, or other causes beyond the control of the Nebraska Lottery.

31. Any additional local, state, federal or other taxes, expenses or surcharges associated with the prizes not mentioned in these rules are the responsibility of the winner.

32. The Nebraska Lottery is not responsible for any travel, lodging or other expense related to claiming any prize.

33. Prizes consisting of lottery tickets will be mailed to in-state winners only. Out-of-state winners of lottery tickets as prizes will be required to claim their prize at the Nebraska Lottery headquarters office in Lincoln, Nebraska.

34. Any prize may be offset for any delinquent taxes or child support and credited against any outstanding liability pursuant to state law prior to payment.
